Since the final discussions at the highest level between the President of the European Commission, Ursula von der Layen and the British Premier, Boris Johnson, have only confirmed that they are likely to come to 31 December without an "after-brexit" agreement between the parties, we have felt that we have been interested to give them the following information that, from the European Union, has been published about contingency measures thought about, from this side of the Channel, for such an event.
Contingency measures for Brexit without agreement.
The Commission has put forward a number of contingency measures yesterday, 10, with the assumption that the transitional period for the Brexit will be completed on 31 December with no agreement reached.
In the case of road transport, contingency measures are concrete in a proposal for a Regulation that will come into force on 1 January next year, as long as an agreement between the UK and the EU was NOT reached prior to that date, a fact that, as I stated earlier, appears more than likely at this stage.
The measures are to be applied to UK carriers to have access to the EU and will have to wait for EU operators to have access to the UK and have to have their contingency plans submitted by the UK authorities and are, in principle, conditional on reciprocity, and that means that the European Commission reserves its right to suspend them or to amend them if EU operators in the UK are not granted rights equivalent to those recognised in the Regulation to the UK in the EU.
In earlier contingency plans, the UK authorities gave EU operators more beneficial conditions that the EU authorities gave to the UK operators. That's obviously good for our companies.
Those measures, and they do not apply to Gibraltar, will be in force until 30 June, as long as an agreement cannot be reached earlier.
Transport of goods:
Bilateral transport between EU and UK territory and vice versa with UK international authorisationThe following information shall be available:
No international authorisation is required for postal transport, transport of damaged or damaged vehicles, transport in MMA vehicles of less than 3.5 t, transport of medicines or products necessary for health care in an emergency and transport for their own account.
No triangular or cabotage transport.
Passenger transport.
RU carriers may continue to conduct regular and special regular transport, provided that they have authorisations issued before the date of entry into force of this Regulation.
The social and technical regulations of the EU (working times, driving and resting times, tachographs, training of drivers, limiters, seatbelts, movement of workers and passengers' rights) should be respected in the course of authorized transport of passengers and goods.
